TERMS OF SERVICE
PAYMENTS
Invoices for a website or graphic work must be paid either in full or the amount stated on the proposal before SuperGirl Creations can start on any project. The remaining balance of the project total must be paid before the completion and/or delivery of a project.
If the customer fails to pay his or her remaining balance after the completion of their website, the customer’s project will be put on hold. If there is no action or communication on the client’s part, SuperGirl Creations assumes that the client relationship has been abandoned and all files become the property of SuperGirl Creations.
THIRD-PARTY STOCK IMAGES
Stock images and content from a third party may be used in the customer’s website or graphic design. If stock images and content are to be used in the customer’s design, the customer is responsible for the cost of the image(s) and content. All warranties are provided by the original manufacturer for any non-SuperGirl Creations software and hardware.
In addition, it is assumed that any third party images given to SuperGirl Creations from the customer to use in their project are owned or purchased by the customer and the customer has legal rights to use or distribute the images and content. If the customer does not have legal rights to use or distribute the images or content is the customer’s responsibility to obtain any license from the third party to use or distribute the images or content. Moreover, the customer shall indemnify SuperGirl Creations and any of its employees or agents against all claims, liabilities, costs, damages, fees, and expenses (including reasonable attorney’s fees) arising from any action based upon any third-party images and content on the Web Site that is solely provided by the customer.
SuperGirl Creations is not responsible for the misuse of any image license(s) or copyright(s) from any third party obtained from its customers and/or used in the customer’s design or website and/or added or put into the design or website by the customer.
SuperGirl Creations does not misuse or infringe the copyright or license of any images from third parties. SuperGirl Creations does not condone the infringement of copyrights or license misuse of any third-party images.
The customer agrees to defend, indemnify, and hold SuperGirl Creations, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities, and settlements including without limitation, reasonable legal and accounting fees, resulting from or alleged to result from, the customer’s misuse of images, content, or software licenses or copyright. The customer agrees to reimburse SuperGirl Creations for any legal and accounting fees resulting from, or alleged to result from, the customer’s misuse of images licenses or copyrights.
REFUND POLICY
Since SuperGirl Creations sells non-tangible services, once we have received payment from the customer, we are unable to issue refunds. However, we do guarantee our customers 100% satisfaction. We keep working with you to make sure your project is absolutely how you envisioned it.
Unless otherwise stated, prices and details outlined in our proposals and estimates expire 30 days after the proposal date. If no deposit or an initial payment is paid within the 30 days, the prices and details outlined in our proposals and estimates are subject to change.
